1. General Provisions
This website and associated services are operated by HIPIXELS GAMES SRL, headquartered in Brasov, Romania, Tax ID (CUI) 45992820. By accessing and using quicksoftagency.ro, you fully accept these terms and conditions. If you do not agree with any of the provisions, please refrain from using our services.
2. Definitions
"Provider" refers to HIPIXELS GAMES SRL (QuickSoft Agency). "Client" refers to any individual or legal entity using our services. "Services" include web development, UI/UX design, mobile applications, e-commerce, and any other digital services offered by the Provider. "Website" refers to quicksoftagency.ro and all associated subdomains.
3. Use of Services
Users agree to use the website and services exclusively for lawful purposes and in compliance with Romanian and European legislation. It is prohibited to use the services for fraudulent activities, distribution of malicious content, or infringement of third-party rights. We reserve the right to suspend access in case of violation of these conditions.
4. Intellectual Property
All materials on the website, including source code, designs, text, graphics, logos, and multimedia content, are the exclusive property of HIPIXELS GAMES SRL or are used under license. Reproduction, distribution, or modification of these materials without prior written consent is strictly prohibited. Source code delivered to the Client becomes their property only upon full payment for the services, as per the contract.
5. Client Obligations
The Client agrees to provide accurate and complete information necessary for the project. The Client is responsible for the content they provide (text, images, data) and warrants that they hold the necessary rights to such content. Delays caused by lack of materials or feedback from the Client may affect delivery timelines.
6. Payment Terms
Payments are made according to the conditions established in the service contract or the accepted commercial offer. Invoices are issued in accordance with Romanian tax legislation and have a payment term of 14 calendar days from issuance, unless otherwise agreed. Non-payment by the deadline may result in service suspension and late payment penalties in accordance with applicable law.
7. Delivery and Acceptance
Projects are delivered according to the timeline established in the contract or commercial offer. The Client has a period of 7 business days from delivery to provide feedback or request revisions in accordance with the agreed specifications. Absence of a response within the stated period constitutes tacit acceptance of the work. Modifications requested after acceptance may be subject to additional costs.
8. Limitation of Liability
HIPIXELS GAMES SRL shall not be liable for indirect, consequential damages or loss of profit resulting from the use or inability to use the services. Our total liability is limited to the value of services paid by the Client for the respective project. We are not responsible for interruptions caused by external factors, including hosting issues, third-party providers, or force majeure.
9. Termination
Either party may terminate the collaboration with 15 calendar days written notice. In case of termination, the Client shall pay for services rendered up to the date of termination. The Provider shall deliver all completed materials and deliverables to the Client at the time of termination. Intellectual property and confidentiality clauses remain valid after termination.
10. Governing Law
These terms and conditions are governed by the laws of Romania. Any disputes that cannot be resolved amicably shall be submitted to the competent courts of Brasov, Romania. The provisions of the Romanian Civil Code and applicable European legislation shall apply.
